hey everyone...

its quite encouraging to hear about all your experiences...just gives me the confidence tht i mite get mine soon too...

here's my story...I went to australia in november 2007 on a student visa...fell in love..got married in 2008...had a baby in october 2008...got my student visa cancelled through my immigration lawyer in january 2009 so that we cud apply for a fresh spouse visa without violating any immigration rules...

anyways...things didnt go as planned..i came back to india with my son and after a lot of delay...i lodged my application from new delhi office on the 5th of october 2009...got my medicals done on the 23rd of october...but havent yet received any acknowledgement for my medicals...

now considering tht my spouse is an australian citizen by grant and my son a citizen by birth....can any one say as to how long it shud take for them to grant my visa???..its been more then a month now since i lodged the application...im getting soo impatient...:)

please replyyy!!...i wud really appreciate it!!

hi mehnaz, they took 100 plus days from the date of application to grant my visa (applied on 25th Jun, granted on 6th Oct).

Hi Mehnaz,

Sorry for not replying sooner, I am not getting the notifications of posts on this forum through to my email for some reason.

The wait seems about 3.5 - 4 months. My husband applied for his spouse visa on July 31st and we're still waiting now, although he has been told by his case officer for the last 3 weeks that it would be granted 'by end of the week'. Still nothing has arrived. It's very frustrating ... we'd like to make plans to leave.

I am an Australian citizen by birth and our son is an Australian citizen by descent (born here in India), I don't think anything has impact on the time frame.

Just try to be patient, hard but necessary

HI everyone, i am new to this forum, joined it coz i am going to apply for spouse visa 309 next week, i am in India and my spouse is in Australia, so just a query- Can we apply in Australia or we have to apply here only i.e Delhi, and if we have both the options then applying where would be more convenient, i mean in terms of communication and processing times.

thanks for replying....i know we need to have patience...but its just sooo hard...people whose spouses and especially children are citizens shud be given priority i feel!!...oh well..as if wat i say matters...lol

Hi Sahig

You can apply either in Australia or India. If you have a tourist visa or can get one, you will be able to apply for spouse visa in any capital city in Australia once you arrive ... however, they prefer you to apply in your country of origin and will ask lots of questions about why you're not doing that. However, they will ultimately allow it as there is no law against it. It takes longer to be granted that way - 6-8 months - and you cannot work (legally) while the processing is taking place (you'll be put on a bridging visa if your tourist visa expires during the processing time).

Hi Mehnaz

My husband spoke to his case manager again today and has now been told end of next week. So, that will make it four months since submission and even then no guarantee as we have been getting this run-around for the last 4 weeks.

I think you should count on definitely four months from your submission date and not make any plans to leave before that. We're stuck as our tickets are booked for Dec 2nd and now not sure we can leave then. Grrrr

Next update hopefully will be a good one!
