Query on H1 renewal

Hi Indus ladies,

This is the first time i am posting my query onto this forum, hope to get answers, suggestions asap.
My hubby is working in US, we are staying in US for last 7 years. Every 3 years his H1 gets renewed but this time it has taken too long. His renewed H1 has not yet come, i am really worried!
His lawyer has filled a case against his employer as they forgot to send his employment certificate for his H1 renewal. We have paid a good amount to get his H1 sorted in premium service.
Now the situation is, if he wont get his H1 papers he will be forced to work on EAD as his current employer wants him to join them as a permenant employee (which is a good news!) but unless he has his H1 papers in hand, he cant accept the offer. Every day i am praying to God that we should get his H1 papers...
My question is, is this happening because of the current recession? Will they reject his H1? Will we be out of status?

I can't say how long it takes but my husband sent for H1 renewal in Jan beginning and it got approved in a month. And this was in premium processing.

And in my case, I sent for H1 renewal on Dec 11 and it was approved on Mar 11, I am sure my company did that in regular process.
