Default H1 b issue...!

Hello All,

My husband is on H1b, And recently joined another company. We had issues with the earlier consultant regd salary. the Consultant never paid us the amount what he had committed in the contract. He gave us the reason stating the job market to be Bad and my Husband not been able to bag any project. Though within a month my husband got a project he paid us less than what he had committed .

My husband was working for him for 7 mths with low wages and finally got a anotherjob and we moved. But then the consultant didn't pay us one month salary stating a clause in his contract saying we need to bear 4000$ legal and processing fees if we leave before one year of joining him.He also stopped the insurance premiums which resulted in No insurance for us.


I wanted some advice /suggestion on this matter ladies...? Anyone exprienced such issues earlier?
Can we sue him legally...? Or will our case will be valid since he has not paid us what he had committed and also didn't pay us one month Salary...?

Hi Vaidehi,

I would suggest you to speak to DOL if the employer is paying less than what is mentioned in LCA.Even if you tell the emploer that you will be complaining DOL Iam sure he will give all the money back..!! as it is illegal to keep the money like that.ALso post your questions in murthyforums.com

You will get appropriate suggestions.

You have the authority to complain against the company to labor dept. They will take action.please have all proofs like e-mail ,phone calls or any correspondence your husband had with his employer. It will help your case.
