problem to come US by F1-finace

Please help me !

My marriage would be feb 2009 .My problem is to how can i come US.My finace is in f1 status he said he couldn't give me dependent as it is difficult for him to maintain bank balance.But i doestnt whated to write any GRE/TOFEL or do job over there.Other possibity is through H4 but as he would come over india during january he couldnt get H1 for this year.If at all i go through H1 visa by any consultancy to US should i defenetly do job,if i dont do job when i go through H1 visa what happens.So what is the best way in my situation.please help me,i would be really thankfull for all of you people for give me good suggestion.

You want to come to the US after marriage, and not before, if I understand you correctly.

I can list out 2 situations that you find yourself in :

1. Trying to come to the US before marriage :

- If your fiance is a US citizen, then you can try for a fiancee visa for yourself
There is no other way to come into the US as a dependent before marriage.

- You can independently try for an H1B visa (work visa) or an F1 visa (study visa) for yourself.

H1B has a deadline for application, and you will have to try next April (2009) because this year's deadline is already over.

F1 visa : to get this, you have to get the offer of admission from a US university - you will have to give your GRE/TOEFL if you want to apply to a university for MS

- Another option for you is to try a tourist visa. One important point in this case is, that you have to arrange the finances for your stay yourself and prove it to the Consular officials. You can stay in the US only for 6 months at a time if you try to enter on a tourist visa.

2. Trying to come to the US after marriage :

- As a dependent, your entry is determined by your husband's ability to support you. It doesn't matter that you don't want to do anything in the US, but just live with your husband. He has to be able to show proof of finances to bring you as a dependent (either on H4 or on F2)

- You can also try for an H1B visa for yourself, or an F1 visa as I mentioned earlier. These visas are not dependent visas and your husband's status doesn't matter in these cases. However, if you don't work once you get an H1B, then remember that you still have to pay your income tax as long as you are in the US, so it is a risk you must consider.

Thanku sowmya for giving me clear details regarding visa.so i find that only f1 visa is possible for me, as my hubby couldnt show bank balance.H1 is difficult as we have to pay tax even though we dont work.

Yes, F1 is the safest option for you to come to the US independently.

You will have to decide whether you want to do an MS or an MBA, and then take up GRE/GMAT and TOEFL accordingly.

Once you have taken these tests, you can apply to universities here, and when you get the admission offer, you can apply for an F1 visa - However, you can come to the US only 1 month before your college starts, either in August or January.

sowmya i have one more doubt regarding GRE/TOFEL if at all i write gre now & if i apply to universities & get I20 from them for this febuary then what to do.My marriage would be this febuary.I have no chance to go until next august.so could i apply & take leave & join in aug or should i keep my score & shouldnt apply until next year.

Many universities offer Summer Session Admission for MS - i.e., the semester starts in May, so you can come here in April.

Please remember that the deadline for applying will be few months earlier than the registration deadline, so plan accordingly.

You can look up the registration and admission details for the universities on their websites.

Check whether the university you want to attend offers scholarships for Summer/Fall admission and make your decision..

sowmya my doubt is not that.i whated to know how many days would I20 be valid.if i get I20 in january can i join for aug batch.As i whated to get visa before marriage by I20.

Hello Sanju,

Once you get your I-20, you can defer your admission to the next semester. You have to request this from your university advisor and usually they agree to defer the admission for 6 months - 1 year.

So, even if you get admission for January, ask for deferred admission to the next semester i.e. May or 2 semesters i.e August.

Also, I forgot to mention that when you ask the university to defer your admission, they will send you a new I-20 form, for whichever semester you have asked for.
