Default Working on EAD without i-140 approval!

Hi,

Sub:Risk factors of working on EAD when i-140 is pending

Can anyone discuss the risk factors for h4(status) women by working on EAD?

Hi Vaishu!

Have 2 questions for u based on your post.

1. Isn't EAD approved only after the I -140 of the principal is approved & the priority dates are current??

2. Doesn't the H4 visa become void/invalid once the EAD is approved??

Hi,

EAD is an interim benefit given to the applicants within 90 days of applying AOS if and only if the AOS is not approved within 90days of filing(Ofcourse ,approval of AOS within 90days of filing is very rare!,SO they give EADs meanwhile to grant work permit ).


Reply to ur 1 question : Not necessarily!It depends on when we file our AOS.If one files AOS(i-485) after the approval of i-140,then EAD gets approved within 90 days of filing AOS.But When one files concurrently(i-140/485/ap/EAD),then he/she gets EAD within 90 days of concurrent filing.

Reply to ur 2 question : .H4 doesnot get void when one gets EAD approved but becomes void or invalid if he/she works on EAD.H4 status hold good when he/she don't work on EAD.But,using EAD one can actually apply for SSN .
