| | Tenant Problem!
Hi all,
We have been facing problem with our tenant for over 5 mths now, We rented our Apt to a guy in the mth of sept, since we are in US, it took us 2 mths to get the agreement paper preapred on a Stamp paper and the tenant was not ready to pay us the rent without agreement being signed, so we had asked him to hold the rent for 2 mths period. He had paid advance of RS 50000 rs. Now that its been 2 mths from our side that we sent him the agreement , Tenant has been finding some excuse to get into a Contract nor he is paying us the Rent.
We are worried for our Apt, and have told him strictly to vaccate the house but now nor does he responds to our mail or picks our phone call. I am a bit worried Can anybody suggest me how to deal with such a person.

Vaidehi ,
My naive suggestion would be is it possible for any of your friends or relatives in Chennai to visit the flat and speak to the tenants directly.Distance just adds more confusion to the situation and things of this kind should be best handled in person.
Glad that you have received advance.Probably he is planning to vacate the flat for some reason and because has already paid the advance he wants to evade the rent and disappear after a month or so.

Tenants creating problems to nri owners is becoming a common issue these days, i have heard about one/two cases in the last few months..it is not that locals are also not being harassed.
1. did you take the advance in the cheque.
2. you should always send the agreement by courier/regd.post and take the proof of the post being sent. in case of problems, it is a proof that you have sent the contract.
3. As sabitha says, do ask your person in chennai to talk to them.
4. with the cost of living going high, pay cuts in most companies, may be he is having a genuine reason to..but again you are a better judge.
5. you should have taken the rent as it is and could have the agreement prepared with a later commencing date. since the agreement that we usually make is n ot too binding,as most of the time it is not registered and is only 11months contract.
I hope the advance covers the few months of rent???

I was just expecting a FB from u on this post, since i have seen so many real estate views of urs on this section.
The thing is the Tenant wanted Agreement on a Stamp Paper, we prepared a document and have sent a Pdf version to him, he said he will be printing it out on a Stamp Paper. Though the Advance covers few earlier months of rent, we are worried for our house now. He had transfered the Advance to our bank account thru e transaction
We have asked him to vaccate the house by gvg him one month notice, but he said he can vaccate only by Feb End. We agreed to that too and asked him to pay the rent atleast. He asks us to deduct it from the Advance.
I just wanted to know what are our chances if God Forbid he takes us for ride?
Please Guide me

Thanks for the confidence dear.
I assume the property is in chennai. because the maharastrian acts are different (because i briefly remember your being an mumbaite??)
Adjusting against the rent is a common practice. but you should ask your person in chennai to have a look at the property for any damages, and collect for that too, along with electricity and other bills that are payable by the tenant.
by e-transfer was it bank to bank in the sense account to account or cash deposit..if it was account to account that will still be a proof.
Did you sign the agreement from your side??. in the pdf..
Just wait till the feb end, and be firm. don't show that you are scared or worried, that could make them look at it as a chance to act upon.
Things should work out fine dear..since it is only months of renting, it should not be a problem..
in future, if it is an apartment, always ask somebody in the same premises to keep watch over, since it is difficult for people to go and check periodically.

Thank u so much for ur kind reply, The Property is in Bangalore, and the guy is from Tamilnadu.
No we didn't sign the Agreement ,since he said he will take the copy on a Stamp paper, we insisted on he fisrt taking a print out and sending it to us.
He did a Account to account transfer and has paid one mth rent by cash.
we had someone in the same premises to have look at the property, but our badluck he had to shift recently. Now keeping our Fingers crossed to get it back safely.

hi all,
i have also faced problem with tenants. they know very well that we are far away from them. i got vexed with each tenant. some tenants are good . they have not remitted the rent regularly.if the tenants are working in bank, no problem to us. otherwise we have to face every problem......

I have a tenant that caused some damage to my rental property. The tenants have close to 9 months left on their lease. Instead of collecting the money for the damage now and notifiying the tenants. I would like to deduct the cost of the damage from their security deposit at the end of their lease, which is 9 months from now. Can I do this? Do I have to notify the tenants now? I prefer not to notify the tenants now for fear of retaliation or bad blood.
