Default Getting H1 visa.....

Hello all,

I am shruti from mumbai. I know this is not the right forum for me, but I need the info related to H4.
I am a S/w engineer with a 2 yrs of exp. And my fiancee is studying in CA and gonna be soon on H1.
Now, the point is to get together, one of our options is to get married and i get there on H4 visa. But I want to work in usa and I cant just stop working and spoil my career.
I know that there are very intellectual ladies in the forum, so I would like to know what are my chances of getting H1visa after getting there on H4. Is there any minimum duration to stay on H4 and den apply for H1visa?? Or its just that if i get a job there and find a company who is ready to sponsor my visa, then its all done????
I hope u all understand my problem....
Or is there any other option to get there to be with my husband.
Plz plz help....

Hi Shruti,

I think it is better you get H1 visa in India if possible and then come to US. For 2008, all H1 visas will be applied in April and they get over very very fast. If you come here on H4 and then want to get a H1 here itself, you have to wait and apply only in Early 2008.

I cannot advise on which is better. It depends on what you really want.

I am trying for getting H1 directly, but in case i dnt get it and i have to marry then, I would want to knw the rules for H4 to H1...
If i take care of the deadlines and den come der accordingly, like i come there in Jan , find a job and apply in april,,,,is this plan feasible????

Hey shruti

if u come here on H-4, u can apply H1B thru brokers over here... there are many but u just dont know whom to trust... once u have the visa then job is not a problem...

But be very careful before spending even a penny in this country... cos i have known a few people who spend 2k-3k $ and then cudnt get visa and they are still fighting to get back their money, and are still on h-4... i didnt mean to scare you or anything, but one has to be careful.

Hi Shruti,

After you come here, you can apply for your H1 through consultants. But you should be careful with them too.

I don't know if you can come here in Jan on H4 and immediately apply for H1. People start the process with the consultants from Feb/March and the consultants will apply for the visa in April. If they get a H1, they can start working only from October.
They have rules and rules and rules, and they keep changing them as they wish.

IS ur company sponsoring ur H1 ? I mean if you apply from India, is it thru ur current company or thru applying for a new company ? Coz I am sailing on the same boat . An year and half experience in s/w. Cant imagine sitting home for 9 solid months. Can u share any other info you got with me ?
