Threatening Tenant

    We have a situation where tenant is threatening that they wouldn't vacate at the end of the lease term if we do not pay them 1000$. They are simply finding ways to give trouble though we had been lenient and unfortunately they are Indians too. Is it possible to go to small civil court before the end of the lease term or should we wait until the lease term is over.

    Check the laws for the community in which you live. There should be a housing board office. Then you will know what you are up against. You might want to record them asking for the bribe as that is definitely blackmail and illegal.

    I live in NYS and there are many horror stories about trying to get rid of renters here. I seem to remember that it can take up to a year to get rid of them even when they are not paying rent. There are some laws to protect people from getting homeless. My neighbor had a place up near the Canadian border and he had so much trouble getting rid of his renters he finally told them he was going to burn the house down and meant it and finally got rid of them that way (that is also illegal btw).

    Finally, we had to pay $300 for them to leave. Worst tenants who gave us a piece of advice that an eviction can take up to 6 months and they were clueless that if eviction was filed it would go into their records and being professionals it would affect them in long-term.

    Good for you that you got this sorted out so quickly. Here in NY it can take a year. If you take off work a couple days to do legal stuff it will come to that 300 for sure. I never understand how some folks can stand the irritation of being a landlord as their source of income.

    and those people were highly qualified professionals in research field with their research work published in one of the leading magazine .... shame on their education that did not teach them values.
